Offences and Penalties

The purpose of the Sale and Supply of Alcohol Act 2012 is to put the processes and system in place to meet the objective of the ACT – the system of licences and certificates and the offences and penalties. In this section we will ask you the strategies you can and should use to avoid breaching the penalties.

The offences relating to minors are = serving or supplying alcohol to minors, allowing minors into restricted areas or supervised areas without a parent or legal guardian.

Offences relating to Intoxicated Persons

The offences are you cannot serve or supply alcohol to intoxicated persons, you cannot allow an intoxication to remain on the premises, and you cannot allow someone to become intoxicated.

Offences relating to ending of the licence hours

Customers have to leave within a certain time from the licence stopping, staff within a certain time from the licence stopping – please write the correct time for each below

Dealing with Prohibited People

Prohibited People are those intoxicated (alcohol or other substances) , Minors if they are in restricted areas or supervised without being accompanied by a parent or legal guardian and those people who are disorderly.

Disorderly People are prohibited from being on the premises or remaining on the premises give four examples of disorderly behaviour

There are lots of things you need to remember when you operate licensed premises. Fire Compliance

For buildings that can accommodate 100 people or more and/or 10 more are employed and/or 5 reside on premises – If not, then an approved evacuation scheme that meets the requirements of the Fire and Emergency Act New Zealand must be in place. Fire Safety Officers can make application to ARLA for cancellation or suspension of licences if there is no compliance with the fire safety requirements.
